This Privacy Policy describes how Art Gharana LLC, 13717 Camp Comfort Ln, Austin TX 78717 USA (“Art Gharana LLC,” “we,” “us,” or “our”) and its wholly owned subsidiary Artgharana Global Private Limited, 178 Panchvati Vastra Nagar, Roshni Ghar Road, Jayendraganj, Lashkar, Gwalior 474001 India (“Art Gharana India”) collect, use, disclose, and safeguard personal information when you access or use any of our websites, mobile applications, online classrooms, or other digital services that link to this Policy (collectively, the “Services”).

By using the Services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree, please discontinue use of the Services.

1. Entities and Scope

  • Art Gharana LLC is the data controller for all users located outside India.
  • Art Gharana India is the data controller for users located within India.
  • Both entities operate under the brand name Art Gharana and share infrastructure, support systems, and secure databases under inter-company data-processing agreements.
  • This Policy applies worldwide to all learners, parents/guardians, visitors, and other users of our Services.

2. Information We Collect

A. Information You Provide

We collect personal information that you voluntarily give when you:

  • register for or purchase a course, subscription, or free trial;
  • request a demo or contact our support team;
  • participate in live or recorded online classes;
  • complete surveys, feedback, or contests;
  • post comments, testimonials, or upload materials;
  • interact with instructors or staff via chat, audio, or video.

This information may include:

  • name, email address, telephone number, country, and time zone;
  • parent/guardian name when enrolling a minor;
  • billing address, payment method, and transaction details (processed through PCI-compliant vendors);
  • account login credentials;
  • age, art form preference, experience level, and course history;
  • messages, questions, or assignments you submit;
  • audio-visual recordings of classes in which you participate (see Section 6).

B. Information Collected Automatically

When you use our Services, we and our service providers automatically collect:

  • Legal Requirements— We may disclose information to comply with subpoenas, court orders, or governmental requests; to enforce our Terms of Use; or to protect users and property.

  • Public Interaction— Information you post on forums, reviews, or testimonials may be visible to others.

We do not sell personal information for monetary value.

6. Class Recordings and Video Content

All classes conducted through Art Gharana’s online platforms are recorded (audio and video).

Purpose of Recording

  • to allow students to revisit sessions for practice and improvement;
  • to maintain quality assurance and instructor evaluation;
  • to provide a legal safeguard for both learners and teachers.

Consent and Participation

Enrollment or continuation in any Art Gharana course constitutes explicit consent to recording.

We do not separately verify parental consent for minors; registration by a parent/guardian is deemed consent on behalf of the child.

Recordings cannot be paused or disabled for individual students. Participants uncomfortable with this policy should discontinue the Service.

Use of Recordings

  • Recordings are stored securely and accessible only to authorized personnel and the enrolled student/family through controlled links.
  • Clips may occasionally be used for instructor training, internal audits, or promotional content only with additional consent.
  • Upon permanent withdrawal, parents or adult students may request deletion of identifiable recordings, subject to legal retention requirements.

7. International Data Transfers

  • Data of users outside India is primarily processed and stored in the United States by Art Gharana LLC.
  • Data of users within India is processed by Art Gharana India.
  • Transfers between these entities occur under Standard Contractual Clauses and equivalent safeguards consistent with GDPR, DPDP, and U.S. law.

8. Data Retention

We retain personal information only as long as necessary to:

  • deliver and support the Services;
  • meet legal and accounting obligations;
  • resolve disputes or enforce agreements.

Video recordings are normally retained for three years after the learner’s last active session unless deletion is lawfully requested or mandated. When data is no longer needed, it is securely deleted or anonymized.

9. Cookies and Analytics

We and our providers use cookies, web beacons, pixels, and local storage to:

  • remember user preferences;
  • authenticate logins;
  • analyze performance and usage patterns;
  • provide general promotional messaging.

You may manage or disable non-essential cookies in your browser settings. Some functionality may be limited if cookies are blocked.

10. Children’s and Minor Learners’ Information

Art Gharana welcomes learners of all ages.

For children under 13 (U.S.) or under 16 (EU/UK), parental or guardian registration constitutes valid consent under COPPA and comparable laws.

We collect only information necessary for course participation—name, age, contact details, and recordings as described above.

Parents or guardians may request deletion of their child’s data upon permanent withdrawal by contacting us at the addresses in Section 17.

11. Security of Information

We employ administrative, technical, and physical safeguards to protect data, including:

  • restricted, role-based access;
  • background-checked staff and teacher training;

16. Changes to This Policy
